Under the work injury compensation process, the injured worker is responsible for filing a claim for benefits with his or her self-insured employer or the Ohio Bureau of Workers' Compensation. The self-insured employer has the option of accepting the claim or referring it to a hearing with the Industrial Commission of Ohio. The Ohio Bureau of Workers' Compensation either initially allows or denies a claim. If denied, the injured worker must file an appeal within 14 days of the Bureau's denial. Appeals are heard in front of the Industrial Commission of Ohio.
Initial determinations regarding medical benefits are made by the injured worker's Manage Care Organization (MCO) or by their self-insured employer.
